Privacy of individual visitor data is vital to Kolbe’s business. Kolbe works diligently to protect confidentiality, restrict transfer of personal data, incorporate technical safeguards and appropriate security policies, and identify privacy implications in new services.

Kolbe Corp (“Kolbe”) has created this privacy statement in order to demonstrate our firm commitment to privacy. The policies described on this page apply to www.kolbe.com and secure.kolbe.com.

Collection of Information

As is true of most web sites, we gather certain information automatically and store it in log files. This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, and site functionality.

Technologies such as cookies, beacons, tags, scripts are used by Kolbe, our partners (e.g. marketing collaborators and sister companies), and analytics. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We use cookies for the shopping experience to identify any discounts you might be eligible for and to identify your session while viewing your reports. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features, receive discounts or use of some areas of our site may be limited. We and third parties with whom we partner to provide certain features on our site or to display advertising based upon your Web browsing activity use Local Story Objects (LSOs) such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML5 LSOs.

We partner with a third party to either display advertising on our Web site or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here. Please note this does not opt you out of being served ads. You will continue to receive generic ads.

Our site’s registration form asks users to give us contact information (such as their name, address, and email address) (Note: see the Minors section regarding the collection of information from a minor). We use customer contact information from the registration form to send the user information about our company. We occasionally send email messages to people who opt-in to receive communications from us. These email messages provide transaction notices, updates about the company, inform people about promotions, and let them know of upcoming events; see the Communication Section below. Users may opt-out of receiving future mailings; see the Choice/Opt-Out and Change/Modify section below (Note: see the Minors section regarding contacting minors). Financial information that is collected is used to bill the user for products and services.

Demographic and profile data is also collected on a voluntary basis at our site. Kolbe Corp will not distribute a user’s private data or information concerning the user or the user’s order to anyone outside our organization unless the user selects the option to share their name and email address with our our Corporate Affiliates: The Center for Conative Abilities and Dynamynd, Inc. (Note: The only exception may be if we were to be subpoenaed or ordered by a court of law to disclose such information; see the Sharing section below.) Much of this information is used for processing of a Kolbe Index and becomes part of our research database. This allows us to continue doing research about conation on an anonymous basis.

Our site uses an order form for customers to purchase products and services; see the Sharing section below. We collect visitors’ contact information (such as their address and email address) and financial information (such as their account or credit card numbers). Contact information from the order form is used to send orders to our customers. Users may opt-out of receiving future mailings; see the Choice/Opt-Out and Change/Modify section below. Financial information that is collected is used to bill the user for products and services.

We post client testimonials on our web site which may contain personally identifiable information such as a client’s name. We do obtain the client’s consent to post their name along with their quote prior to posting the testimonial. If at any time the client changes their mind and would like the testimonial removed, an email can be sent to Kolbe Corp at info@kolbe.com with “Remove My Testimonial” in the subject line. Please include the quote, the page it was on, and the full name in which the testimonial was sited. After the information has been verified as a valid request, the information will be removed.

Our website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at info@kolbe.com with “Remove My Information from [state the blog or forum]” in the subject line. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Our blog is also managed by a third party application that may require you to register to post a comment. We do not have access to or control of the information posted to the blog. You will need to contact or login into the third party application if you want the personal information that was posted to the comments section removed. Our site may also conduct surveys or run contests during which similar information will be collected and used for the same purposes listed above.

Our Web site includes Social Media Features, such as the Facebook Like button (Widgets, such as the Share this button or interactive mini-programs that run on our site). These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

Our website includes links to other websites whose privacy practices may differ from those of Kolbe. If you submit personal information to any of those websites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any website you visit.

MINORS

Any person representing themselves as being 13 years or younger will not have personal, identifiable information collected, will not be eligible for sharing information with our Corporate Affiliates, and we do not knowingly collect information from anyone under the age of 13. The information required will be limited to the bare minimum for our systems to work – first name, last name*, parent/guardian email*, gender*, username, and password. All other non-personal, identifiable demographic information may be used for research purposes. Parent/guardian email address will be used to notify the parent/guardian of activity on this account and additional information regarding Kolbe Corp services as it relates to their child. Full name assists in identifying who owns the Index/report – crucial for facilitating Indexes for groups of children and identification of reports. Gender will allow us to enhance the reports generated for parents/guardians by including appropriate pronouns (“his” “hers” etc). Age is a required field for those who take a Kolbe Index and are creating a new account. Anybody who identifies themselves as a minor will not receive marketing communications or have their information shared with third parties.

*This modification to the privacy policy as of 4/5/2015 will only affect new users of Kolbe.com. This additional information added to the account creation process for minors will allow us to enhance the benefits, security and privacy of our youth users.

Sharing

  • We will share your personal information with third parties only in the ways that are described in this privacy policy. We do not sell your personal information to third parties.

  • Legal Disclaimer

    Though we make every effort to preserve user privacy we may need to disclose personal information when required by law, such as to comply with a subpoena, or similar legal process, wherein we have a good-faith belief that such action is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, comply with a current judicial proceeding, a court order or legal process served on our Web site.

  • Aggregate Information (non-personal, identifiable)

    We share aggregated demographic information with our partners and Corporate Affiliates. This data contains generic demographic information regarding the statistical analysis of visitors/users of the site. This information may be shared with investors, research teams and strategic partners with the interests of the users leading the way. This information is not linked to any personal, identifiable information when presented to Corporate Affiliates.

  • Affiliates and Corporate Affiliates

    Affiliates associated through the automated Affiliate Program on Kolbe.com are not automatically deemed a Corporate Affiliate and are not able to access any personal, identifiable information from people in which they refer to Kolbe.com. The Affiliate Program tracks products and the dollar amount spent.

    We share Personal Information with Corporate Affiliates only.

    We never share user personal, identifiable information with our Corporate Affiliates unless the user opts in to have their information shared. The personal information we share with our Corporate Affiliates is first name, last name, and email address. This information will be used by the Corporate Affiliate to send communications regarding services, products, updates, news, events, and other promotional reasons. Please see the Choice/Opt-Out and Change/Modify section.

  • Third Party Intermediaries

    We use a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personal, identifiable information for any secondary purposes. These companies are authorized to use your personal information only as necessary to provide these services to us.

Merger / Acquisition

  • If Kolbe is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Security

When a user pays for an Index or places an order online, the user’s personal information and credit card information are processed and encrypted by our offsite secure server, www.kolbe.com and secure.kolbe.com, using industry-standard SSL encryption. SSL is short for Secure Sockets Layer, a protocol developed by Netscape for transmitting private documents via the Internet. SSL works by using a private key to encrypt data that is transferred over the SSL connection. Current major browsers support SSL. When you visit a page that requires an SSL connection, it starts with https: instead of http:. The benefit to housing our server offsite is to provide additional security, secure 24-hour maintenance and backup for our site. Those benefits are then passed on to you, our users. The company that houses the offsite server has limited access to personal and order information captured during the ordering process for purposes of monitoring and troubleshooting errors on the system. They do not, however, have access to secure credit card information.
We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Communication from the Site

  • Customer Service

    We send all new members a welcoming email to verify password and username. We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account we reply via email and/or phone, in accordance with the users’ wishes.

  • Newsletter

    On occasion, we might send out a newsletter. If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address. Out of respect for our users’ privacy, we provide a way to opt-out of these communications. Please see the Choice/Opt-Out and Change/Modify section.

  • Transactions

    Every time a transaction is made on the website a transaction email is sent to the account performing the transaction. If the user is identified as a minor, the transaction email should go to the parent or individual whose credit card and email address was used.

  • Service Announcement

    On occasion, it is necessary to send out a strictly service-related announcement for all users. For instance, if our service is temporarily suspended for maintenance we might send users an email. However, these communications are not promotional in nature.

  • Special Offers and Updates

    Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users, we present the option to not receive these types of communications. Please see the Choice/Opt-Out and Change/Modify section.

Choice/Opt-Out and Change/Modify

Our site provides users the opportunity to opt-out of receiving most communications from us. The user is currently provided an all-or-nothing option for receiving Service Announcements, Special Offers and Updates, and Newsletters. If the user chooses not to receive communications from us, then this site gives users the following options for removing their information from our database used in future communications. (There is no opt-out option for Transaction or Customer Service emails).

You can change your communication options via Profile Settings after logging into secure.kolbe.com. (click here, username and password required) You can unsubscribe using our online contact form. You can click on the Opt-Out option included in received email. You can send email to info@kolbe.com with “remove” in the subject line or contact us.

Our site also gives users the option for changing and modifying or removing information previously provided. Demographic information and sharing agreements can be changed in your Profile Settings after logging into your profile. (click here, username and password required)

We will retain your data until requested, in writing, to delete such data from our records by the person or entity who created the account that contains such data and by the person or entity that purchased the products or services for which the data was collected. We will respond to your request within a reasonable timeframe. We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your data as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Changes to Privacy Policy

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use users’ personal, identifiable information in a manner different from that stated at the time of collection we will notify users via email prior to the change becoming effective. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our Web site notifying users of the change prior to the change becoming effective. In some cases where we post a notice, we will also email users who have opted to receive communications from us, notifying them of the changes in our privacy practices.
